General Terms & Conditions

Application of Terms

All quotes provided, orders placed, and goods supplied by Kara1 Pty Ltd Trading as Acrilam (“the Supplier”) to any customer (“the Buyer”) are subject to these Terms & Conditions, unless otherwise agreed in writing by an authorized representative of the Supplier.

Pricing & Account Management

Pricing is determined based on volume and managed through your designated regional Account Manager.

Prices are based on ruling wage rates, raw material costs, customs, tariffs, exchange rates, and freight rates. The Supplier reserves the right to adjust prices to reflect any variations occurring between the date of the order and the delivery of the goods.

Payment Terms & Overdue Accounts

Unless otherwise agreed in writing, payment must be made in full within 30 days of the invoice date.

The Buyer agrees to pay interest on all overdue amounts at a rate of 2.5% per month from the due date until the date of payment in full.

New trade accounts are subject to credit checks, credit limits established by account managers, and final management approval.

Retention of Title (Ownership)

All goods delivered to the Buyer remain the absolute property of the Supplier until all sums due from the Buyer under this or any other contract have been paid in full. Until full payment is made:

  • The Buyer holds the goods as a bailee of the Supplier and must store them separately from other inventory.
  • The Buyer has the right to sell the goods in the ordinary course of business, but all proceeds must be held on trust for the Supplier until all debts are settled.

 

Delivery and Risk

All goods delivered to the Buyer shall be at the Buyer’s risk from the time of delivery. It is the Buyer’s responsibility to maintain adequate transit and property insurance. For full details on how we handle shipping, please refer to our Freight & Shipping Policy.

The Supplier is not liable for any loss or damage (including consequential loss) resulting from late delivery or events beyond the Supplier’s control (such as strikes, material shortages, or natural events).

Product Warranty & Limitations

Acrilam products are covered against manufacturing defects for 7 years in residential applications, and 12 months (1 year) in commercial or non-residential applications, subject to full payment. You can read the full breakdown of coverage and conditions on our Product Warranty & Care Guide page.

The warranty does not cover fair wear and tear, water/heat damage, chemical exposure, structural movement, improper installation, or visual blemishes (such as scratches or chips) that are not reported before the product is cut or modified.

The Supplier’s total liability under any claim is strictly limited, at the Supplier’s option, to the repair or replacement of the defective goods, or a refund up to the invoiced amount of the product.

Governing Law

These terms are governed by the laws of the State of Victoria, and both parties submit to the jurisdiction of the courts of that State.

Amendment of Terms

The Supplier reserves the right to review, amend, or update these Terms & Conditions at any time. In the event of any inconsistency, discrepancy, or lag between the terms published on the Acrilam website and the terms issued on physical documents (such as quotes, order confirmations, or invoices), whichever document or publication bears the latest date or most recent update shall take precedence and apply. It is the responsibility of the Buyer to review the current applicable terms. Continued ordering of goods constitutes acceptance of the prevailing terms at that time.
